Under the MHADA Estate Management Regulations, 1981, a tenant of a rental tenement must not sub-let any part without the Authority's previous permission (regulation 28(3)(d)). An allottee can enter a caretaker arrangement only with the Chief Officer's prior written permission (regulation 30). Ask the owner for the permission letter before you pay.
What the record says
- Regulation 25: a transfer of an allotted tenement needs the Board's previous written permission, and the society's if formed.
- Regulation 30(1): caretaker arrangement needs prior written permission of the Chief Officer.
- If the arrangement runs beyond five years, the Board's approval is needed.
