Section 3E of the Maharashtra Slum Areas Act bars an allottee from transferring a rehabilitation tenement by sale, gift, exchange, lease or otherwise for five years from allotment. After that, transfer needs the Slum Rehabilitation Authority's permission. If a tenement is transferred in breach, the Competent Authority can order the person in possession out. Ask the Authority before you pay anything.
What the record says
- Five years from the date of allotment (changed from ten years by Mah. 15 of 2024, section 2).
- After five years, the allottee needs the Authority's permission, under the prescribed procedure.
- If the bar is broken, the Competent Authority can direct eviction of the person in possession (section 3E(2)).
- Ask for the allotment date and the Authority's written permission.
