Does my society need to give a NOC for a tenant in Mumbai?

Under the Co-operation Department's model bye-laws, a member does not need the society's permission to give a flat on leave and licence.

( SCROLL ↓ )

The member must tell the society 8 days before, and give a copy of the registered agreement and the police intimation. Your society's own registered bye-laws decide, so ask for them. A non-occupancy charge may be levied, capped at 10 per cent of the service charge.

What the record says

  • Model bye-law 42(2) (tenant co-partnership model, 2014) and 43(2) (proposed model): no permission needed, 8 days notice to the society.
  • The member must give the society a copy of the agreement and the police intimation report.
  • Non-occupancy charge: 10 per cent of the service charge (rule 106C-12, Co-operative Societies Rules, as amended 18 June 2026).
  • The IGR model agreement puts non-occupancy charges on the owner.
